Terms of Use

ListingShot lets you enhance real-estate photos using AI tools, including removing furniture and clutter (Declutter), furnishing empty rooms in a chosen style (Virtual Staging), and improving exposure and lighting (Lighting Enhance). The Service is provided login-free: an anonymous, device-based identity is created automatically so the App can function. We may add, change, suspend or remove features of the Service at any time.

You must be at least 13 years old, or the minimum age of digital consent in your country, and able to form a binding contract, to use the Service. If you use the Service on behalf of a business (for example, a brokerage or agency), you represent that you are authorised to accept these Terms on its behalf.

Subject to these Terms, Kodera grants you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App on an Apple-branded device that you own or control, solely for your own real-estate listing and personal or internal business purposes, and in accordance with the Usage Rules in the Apple Media Services Terms and Conditions. You may not rent, lease, lend, sell, redistribute or sublicense the App.

You retain ownership of the photos and images you upload ("Your Content"). You represent and warrant that you own Your Content or have all rights, licences and permissions necessary to upload it and to have it edited, including any rights of people, brands, artwork or property visible in the images.

You grant Kodera a limited, worldwide, royalty-free licence to host, store, process, transform and create derived images from Your Content solely to provide and operate the Service for you — for example, to generate results and detect room types. This licence ends when Your Content and the corresponding results are deleted in line with our retention practices, except where retention is required by law. We do not claim ownership of your results, and you are free to use them subject to these Terms and applicable law.

Results are produced by automated artificial-intelligence systems and are provided on an "as is" basis. They may contain inaccuracies, artefacts or details that differ from the real property, and they may not be suitable for every purpose. We do not guarantee any particular result. You are responsible for reviewing every result before using it and for deciding whether it is appropriate for your listing.

ListingShot produces edited and AI-generated imagery, including virtually staged and decluttered rooms that do not depict the property in its current physical state. Many jurisdictions, real-estate regulators and listing platforms require that staged, enhanced or otherwise materially altered photos be clearly disclosed (for example, labelled "virtually staged"). You are solely responsible for complying with all such laws, rules and platform policies, for disclosing edited photos where required, and for the accuracy and legality of any listing in which you use the results.

You agree not to use the Service to: upload content you do not have the rights to use; create misleading, fraudulent, defamatory, infringing or otherwise unlawful imagery; misrepresent a property in a way that is deceptive or illegal; infringe the intellectual-property, privacy or other rights of any person; upload content depicting a person without the necessary rights or consent; or attempt to interfere with, disrupt, overload, reverse-engineer, scrape, or circumvent the security or usage limits of the Service. You are responsible for ensuring your use of the Service and of any results complies with all laws and third-party rules that apply to you.

The Service may be offered free of charge during a beta period. Outside of beta, generating photos consumes credits. Credits are purchased as in-app purchases through the Apple App Store on a one-credit-per-generated-photo basis and do not require an account. Purchases are processed by Apple and are subject to the Apple Media Services Terms and Conditions; entitlements may be managed through RevenueCat.

Except where required by applicable law or by Apple's policies, purchases and credits are non-refundable, have no monetary value, are not exchangeable for cash, and are non-transferable. You may restore eligible purchases through the App. Prices, credit packs and the terms of any free offering may change over time.

The Service, including the App, this website, the ListingShot and BrandScale names and logos, and all related software, designs and content (excluding Your Content), is owned by Kodera or its licensors and is protected by intellectual-property laws. Except for the limited licence to use the App granted above, these Terms do not grant you any right in our brands, technology or content.

The Service relies on third-party services, including Apple, RevenueCat, Cloudflare, Expo and third-party AI providers. Your use of the Service may be subject to those third parties' terms, and we are not responsible for the acts, omissions, products or policies of third parties.

The following terms apply to your use of the App obtained from the Apple App Store and, in the event of any conflict with the rest of these Terms regarding the App on Apple devices, control with respect to that subject matter:

(a) Acknowledgement. These Terms are concluded between you and Kodera only, and not with Apple Inc. ("Apple"). Kodera, not Apple, is solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

(b) Scope of Licence. The licence granted to you for the App is a limited, non-transferable licence to use the App on any Apple-branded products that you own or control, and only as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing where applicable.

(c) Maintenance and Support. Kodera is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

(d) Warranty. Kodera is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Kodera's sole responsibility.

(e) Product Claims. Kodera, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including: (i) product-liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy or similar legislation, including in connection with the App's use of any third-party software.

(f) Intellectual Property Rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual-property rights, Kodera, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual-property infringement claim.

(g) Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

(h) Developer Name and Address. The App is provided by Kodera. Any questions, complaints or claims regarding the App should be directed to Kodera through the contact page at https://listingshot.co/contact.

(i) Third-Party Terms of Agreement. You must comply with applicable third-party terms of agreement when using the App.

(j) Third-Party Beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, that results will be accurate or reliable, or that the Service will meet your expectations.

To the fullest extent permitted by applicable law, Kodera and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business, arising out of or relating to your use of, or inability to use, the Service or any results it produces, even if advised of the possibility of such damages. To the fullest extent permitted by law, Kodera's total aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid to Kodera for the Service in the twelve months before the claim, or fifty U.S. dollars (US$50). Nothing in these Terms limits liability that cannot be limited or excluded under applicable law.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Kodera and its affiliates from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.

We may update these Terms or the Service at any time. When we update the Terms, we will revise the "Last updated" date above, and material changes will be reflected on this page. We may also suspend or terminate your access to the Service, in whole or in part, where reasonably necessary, including for violations of these Terms. Your continued use of the Service after an update means you accept the revised Terms.

These Terms are governed by the laws of the jurisdiction in which Kodera is established, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence provide otherwise. Nothing in these Terms affects your statutory rights as a consumer.
